Terms and Conditions.


General

 

1.1. In these conditions, Posh Clinic is defined as: Posh Clinic located at Polderweg 98 in Amsterdam and the skin therapists affiliated with Posh Clinic.

1.2. In these conditions, 'client/patient' means the person who instructs Posh Clinic to provide treatment.

1.3. In these conditions, 'client/patient' also means his legal representative.

1.4. These conditions form part of every agreement between the client/patient and Posh Clinic.

1.5. These conditions also apply if Posh Clinic involves third parties for the execution of the assignment.

1.6. The effect of Article 7:404 and Article 7:407 paragraph 2 of the Dutch Civil Code is expressly excluded.

 

Agreement

 

2.1. The agreement between Posh Clinic and the client/patient includes the client/patient's assignment to Posh Clinic for treatment.

2.2. Posh Clinic is entitled not to respond to an unreasonable desire of the client/patient and may refuse to carry out treatment.

2.3. Cancellation or suspension of the agreement is possible if the client/patient behaves improperly or discourteously towards Posh Clinic or its employees or the volunteers working there and/or towards fellow clients or their visitors.

2.4 Posh Clinic has the right to terminate the collaboration provided the client does not fulfill its obligations.

 

Permission

 

3.1. Prior to the execution of the treatment agreement, the client grants unconditional and unreserved permission to Posh Clinic by completing and signing the Posh Clinic intake form.

3.2. Posh Clinic may require the client/patient to confirm his consent in writing.

3.3. The client gives unconditional and unreserved consent - taking due care - to the registration of his personal data and medical data that are relevant to the treatment and the completion of the treatment.

3.4. In the event that the client/patient refuses or withdraws consent, Posh Clinic will no longer provide treatment.

 

Information

 

The client/patient must inform Posh Clinic in a timely manner and keep all information necessary for the proper execution of the agreement.

 

Rates and health insurance

 

5.1. Unless expressly agreed otherwise in writing, rates apply for a calendar year and can be adjusted annually.

5.2. The client/patient is responsible for ensuring that he is aware of whether and to what extent his insurer will reimburse the treatment. Furthermore, it is the responsibility of the client/patient whether or not to declare invoices to his insurer.

 

Payment

 

6.1. The client/patient pays in cash or by card immediately after the treatment.

6.2. If Posh Clinic treats the client on account, the client will ensure full payment within 14 days and the relevant amount will be paid into the relevant Posh Clinic account, stating the invoice number and type of treatment.

6.3. Regardless of whether the invoice is reimbursed by the insurer, the client/patient remains obliged at all times to pay the invoice in full and on time.

6.4. Payments are first deducted from the oldest outstanding invoices.

6.5. If the client/patient does not pay the invoice on time and/or in full, he or she is in default. Posh Clinic is then entitled to charge the client/patient the statutory interest on the invoice amount or the remainder thereof. Posh Clinic is then also authorized to take collection measures. The costs associated with the collection (including extrajudicial costs and other costs) are borne by the client/patient.

6.6. In the event of payment arrears, Posh Clinic is authorized to suspend further treatment or only provide it against immediate constant payment.

6.7. The payment obligation is not suspended because the client/patient files a complaint against Posh Clinic about the invoice and/or the treatment, unless Posh Clinic agrees to the suspension of the payment obligation.

6.7. The payment obligation does not expire if the client/patient terminates the agreement.

 

Cancellation

 

7.1. If the client/patient is unable to attend an appointment, he must cancel this at Posh Clinic at least forty-eight (48) hours in advance.

7.2. If the client/patient does not cancel or does not cancel in time, Posh Clinic can charge the full rate for the treatment.

7.3. Appointments must be canceled by email. The cancellation will be registered when the cancellation is received by Posh Clinic. If the client wishes to cancel her appointment by telephone, this is the client's responsibility. Posh Clinic not being reachable by telephone cannot be a reason for the appointment not being made or not being made on time.


Online Booking and deposit


8.1. When making online appointments, a down payment is made. The deposits may vary in amount, because prices differ per treatment. You pay 20% of the price of your booked treatment. When booking an appointment, a transaction fee of 36 cents will be added. If you reschedule a new appointment at the clinic, you will not pay a down payment.

Your deposit You make a deposit when booking an appointment on our website. Your down payment will be deducted from the total amount when you pay.

 

8.2. Your deposit cannot be reclaimed in the event of cancellation/cancellation. The reason that you will not receive a deposit back is because your appointment has been reserved for us.

If you wish to move/cancel appointments, you must notify us at least 48 hours in advance. Due to our agenda and down payments, we ask you to take this into account.

 

Foreclosure

8.3. We are not responsible for cancellations. The down payment made cannot be reclaimed in the event of cancellation. Appointments must be canceled/changed before 48 hours. If a cancellation is not reported in time, the deposit cannot be reclaimed. If you are unable to arrive on time for your treatment, we will be forced to shorten the treatment. If you arrive 15 minutes or later, we will charge the entire treatment.

 

Cancellation fees

8.4. If you cancel your appointment, we charge €9 administration costs. If you cancel your appointment before 48 hours, you will receive a partial refund of your deposit. The administration costs of the cancellation will be deducted from your down payment. If you cancel your appointment too late, the entire deposit will be forfeited. If you wish to reschedule an appointment, you can do so free of charge 48 hours before your treatment.

 


Liability

 

9.1. If an event occurs during the treatment, including failure to carry out treatment in full or on time, which leads to liability on the part of Posh Clinic, then that liability is limited to the amount covered by the liability insurance taken out by Posh Clinic. gives. However, Posh Clinic is not liable in the event that the client/patient is in default of any obligation towards Posh Clinic at the time the event occurs.

9.2 Posh Clinic cannot give any guarantees about the amount of hair reduction after the treatment(s), or the number of treatments to achieve the desired hair reduction.

9.3 Posh Clinic is not liable for burns and/or damage to the skin caused by, among other things, tattoos, piercings, birthmarks and/or pigment spots.

9.4 Posh Clinic is not liable for (aggravated) pigmentation on the skin after the treatment(s).

 

Complaints

 

10.1. In the event of dissatisfaction or a complaint from the client/patient about the treatment by Posh Clinic, the client/patient must report this by email to Posh Clinic as soon as possible, within 48 hours. Posh Clinic and the client/patient will then both make every effort to find a solution.

 

Nullity

 

If any provision of these terms and conditions is void or voidable, this will not affect the validity of the other provisions.

 

Applicable law

 

The agreement concluded between Posh Clinic and the client/patient, and any further agreements concluded in implementation thereof, is exclusively governed by Dutch law.

 

Change

 

11.1. Posh Clinic reserves the right to change these terms and conditions at any time

11.2. Changes will be notified to the client/patient in writing or electronically via the website (www.poshclinic.nl) and will come into effect one (1) month after the date of that announcement, unless stated otherwise in the announcement. If the client/patient does not object to the change in the conditions within one (1) month after the date of the announcement, the client/patient is deemed to have accepted the change. If the client/patient objects to the change in the conditions within one (1) month after the date of the announcement, this constitutes a ground for dissolution of the agreement.
